JAMESTOWN - In a civil filing before the Russell Circuit Court, James Stuart Faller II individually has initiated a lawsuit against several police officers and the Kentucky Bureau of Investigation.
Within that filing he asked for an emergency hearing for a restraining order against those who he sued, as well asserting his position that the KBI and others be are tampering with the grand jury and allegedly intimidating witnesses.
Faller asked that those named in the indictment be ordered to stay away from those people he says are potential witnesses to the grand jury in support of his allegations of a far-reaching conspiracy among local officials against him and others.
Additionally he filed as an exhibit in support of his motion for the emergency hearing. It was a signed motion on behalf of Melinda Wilson in her lawsuit against the city of Russell Springs and that city's police chief Joseph M. Irvin.
That exhibit is a motion for a restraining order on Wilson's behalf complaining of harassment and property damage she believes has been caused by the police chief.
It was noted in the Circuit Clerk's office that this motion has not actually been filed in the case it relates to, but it was accepted in Faller's exhibits.
Judge Vernon Miniard accepted the case and motions but took no action, according to Circuit Clerk Tony Kerr.
The procedural rules in that court are that any case or motion must be filed at least five days before the court date in order for the judge to have time to review them before making any decision, Kerr explained.
