A plea bargain agreement between one of the defendants in the "Daycare
case" was announced Wednesday morning.
According to records from Circuit Court Clerk Tony Kerr's office charges against Heather Dykes have been dismissed, while Wesley Powell and Rhonda Stapp both entered guilty pleas.
The 13 counts of criminal abuse 1st degree were amended to 2nd degree and in the agreement Powell is to never own or be employed again by a daycare and he was sentenced to five years in prison for each charge but that sentence was diverted, as he was placed on 5 years supervised probation.
Rhonda Stapp, who operated the daycare from her home in the subdivision behind Fruit of the Loom, also entered a guilty plea to 8 amended 2nd degree criminal abuse charges, and five 1st degree charges while one charge was dismissed.
She was sentenced to seven years on each of the 1st degree charge and five years on each 2nd degree charge, with the sentence being diverted for a 5-year supervised probation. She also is to not work in or own a daycare.
