In Aug. 5 IssueThe criminal charges of menacing and disorderly conduct against Russell County Judge-Executive Mickey Garner have been dismissed, according to court records.
The charges were dismissed last Friday by Special Judge Steve Hurt of Burkesville after Special Prosecutor Joe Mattingly of Marion County and Garner’s defense attorney, Jeff Hoover reached an agreement. In the settlement agreement Garner did not admit guilt but stipulated probable cause existed for the charges brought against him.
A trial was set for the head of county government earlier this week in Russell Circuit Court to answer to charges filed by County Attorney Mark McGaha but with the dismissal of charges, the trial did not take place.
The charges stemmed from an argument between Garner and McGaha last December.
The two were in disagreement over a proposed ordinance creating the position of “Alcohol Beverage Control Administrator” as a result of last fall’s wet-dry election in the Jamestown area.
