The U.S. Department of Labor has recovered $104,159.86 in overtime back wages for 24 employees of Treviicos-Soletanche JV who were working on a public repair project funded by the American Recovery and Reinvestment Act.
Treviicos-Soletanche JV, a joint venture between Italian company Treviicos and French company Soletanche Bachy, was awarded a $340 million contract by the U.S. Army Corps of Engineers to perform construction and repair operations for the Recovery Act-funded Wolf Creek Dam rehabilitation project in Jamestown.
After conducting employee interviews and reviewing all relevant time and payroll records, the Labor Department’s Wage and Hour Division determined that 24 administrative and technical support workers were incorrectly identified as exempt from the Fair Labor Standards Act, thereby depriving them of overtime compensation in violation of the law.
“The Labor Department will continue investigations on Recovery Act-funded projects to ensure contractors are properly compensating their employees fully and fairly for all hours of work,” said Oliver Peebles III, the Wage and Hour Division’s regional administrator in Atlanta, Ga. “Treviicos-Soletanche JV required its employees to work long hours and often more than 40 in a single workweek, without paying them any overtime compensation. The resolution of this case should remind all contractors that the department will not hesitate to investigate them if they deny workers of federally-funded projects the proper pay that they are due.”
Treviicos-Soletanche JV agreed to pay the full amount of back wages, properly classify the affected employees as nonexempt under the Fair Labor Standards Act, and maintain accurate time and payroll records for all employees in accordance with the law.
The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers are required to keep accurate records of all hours worked by covered employees.
